By accessing and using the services provided by ClearPower EnergyBeam ("Company", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
ClearPower EnergyBeam provides delivery and logistics services throughout the United Kingdom, including but not limited to:
- Same-day delivery services
- Next-day delivery services
- Standard delivery services
- Special handling for fragile or valuable items
- Express and priority delivery options
3. User Responsibilities
3.1 Accurate Information
You must provide accurate, complete, and current information when using our services, including:
- Correct pickup and delivery addresses
- Accurate package descriptions and contents
- Valid contact information
- Proper packaging and labeling
3.2 Prohibited Items
You agree not to ship the following prohibited items:
- Hazardous materials, explosives, or flammable substances
- Illegal drugs or controlled substances
- Weapons, firearms, or ammunition
- Stolen goods or counterfeit items
- Live animals or perishable goods (unless specifically arranged)
- Items that violate UK laws or regulations
4. Pricing and Payment
4.1 Service Fees
Service fees are determined based on factors including distance, weight, size, delivery speed, and special handling requirements. All prices are quoted in British Pounds (GBP) and include applicable VAT.
4.2 Payment Terms
Payment is due at the time of service booking unless alternative arrangements have been made. We accept major credit cards, debit cards, and electronic bank transfers.
4.3 Additional Charges
Additional charges may apply for:
- Failed delivery attempts due to incorrect information
- Special handling requirements
- Delivery to remote or difficult-to-access locations
- Storage fees for uncollected packages
5. Delivery Terms
5.1 Delivery Timeframes
Delivery timeframes are estimates and not guarantees. While we strive to meet all delivery commitments, delays may occur due to factors beyond our control, including weather, traffic, or other unforeseen circumstances.
5.2 Delivery Attempts
We will make reasonable attempts to deliver packages. If delivery cannot be completed, we will:
- Leave a delivery notification
- Attempt redelivery on the next business day
- Hold packages at our facility for collection
- Contact the sender for alternative arrangements
5.3 Proof of Delivery
Delivery is considered complete upon obtaining a signature from the recipient or authorized person at the delivery address, or upon successful delivery to a safe location as instructed.
6. Liability and Insurance
6.1 Limitation of Liability
Our liability for loss or damage to packages is limited to the declared value of the item, up to a maximum of £1,000 unless additional insurance is purchased. We are not liable for:
- Indirect, consequential, or special damages
- Loss of profits or business interruption
- Delays in delivery
- Damage to items improperly packaged
6.2 Insurance Options
Additional insurance coverage is available for high-value items. Insurance must be declared and paid for at the time of booking.
7. Claims and Disputes
7.1 Reporting Claims
Claims for lost or damaged packages must be reported within 7 days of the scheduled delivery date. Claims should include:
- Tracking number and service details
- Description of the issue
- Supporting documentation (photos, receipts, etc.)
7.2 Investigation Process
We will investigate all claims promptly and fairly. Resolution may include replacement, repair, or compensation up to the coverage limits.
8. Cancellation and Refunds
Services may be cancelled with appropriate notice:
- Same-day services: Minimum 2 hours notice
- Next-day services: By 6 PM the day before
- Standard services: At least 24 hours notice
Cancellation fees may apply based on the timing and type of service.
9. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, government actions, or public health emergencies.
10. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal information.
11. Intellectual Property
All content on our website, including text, graphics, logos, and software, is owned by ClearPower EnergyBeam and protected by intellectual property laws. You may not use our intellectual property without written permission.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.
